STOPPING ILLEGAL DEVELOPMENT
Illegal development is made possible when the municipality in La Paz issues non-compliant building permits. Here are a few examples of what is currently being built in the Residential Tourist zone in complete violation of the PDU.
Once an illegal permit is issued in La Paz the municipality itself must be taken to court. Our team of attorneys file an Administrative Complaint with the municipality in La Paz. By law the municipality is required to investigate the complaint immediately and rectify the situation when violations are discovered.
If the complaint is not investigated immediately, we file an amparo or lawsuit against the municipality for failure to act. As the issuer of the permit, they violated the laws that ironically, they enacted when the PDU became law over a decade ago.
Criminal complaints against the municipality and the individuals who authorized the project may also be filed if corrective action is not taken. The property owner, developer, architect, and contractor may also be named in the criminal complaint. The criminal complaint is investigated by the District Attorneys office and if illegal construction has occurred or is in process criminal charges are brought against those responsible.
But, perhaps the biggest development of all is the filing of the lawsuit to compel the municipality to form a local Advisory Committee as stipulated in the PDU. The advisory Committee’s purpose is to review building permits before they are submitted to La Paz to confirm they comply with the PDU. This lawsuit was submitted by the Delgado of Todos Santos and the Consejo Ciudadano or Citizens Council to the municipality.

We will act against all illegal construction on the dunes and work with permitting agencies to ensure residences, hotels, and commercial buildings are not constructed in single-family-only areas in accordance with the PDU.
Lobby
We will lobby the municipality in La Paz to create the Development Plan Oversight Committee called for in the PDU and ensure the committee reviews all plans for compliance before construction permits are issued.
